Motrex Co., Ltd. and its subsidiaries ("Motrex", "we", "us", or "our") provide the Products and Services in connection with automobiles, including a Mobile Application, named as "[Nissan DVRS]", that conjunctively operates with our Products. 

 

This Privacy Policy provides information on what we do with your personal information and your rights regarding your personal information. Specifically, it describes what types of personal information we may collect, how we may use personal information, and with whom we may disclose or share it. Also, this Privacy Policy describes what choices you may have and how you can contact us about our Privacy Policy. 

 

We collect and use your personal information to provide better services to all our consumers. Each time you provide any personal information to us, you consent to the collection, use, and disclosure or sharing of such information according to this Privacy Policy. 

 

This Privacy Policy is incorporated as part of our Terms of Service. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service.

Information We Collect  

We collect certain personal information in connection with the Products and Services we provide. The types of personal information we collect include: 

 

- Contact information, such as name and email address;

- Account information, such as online ID and other log-in details used to access our Services;

- Payment information, such as name, billing address, and payment card details, which is collected and stored by the Payment Processors on our behalf; 

- Geolocation information, such as physical location of your dashboard camera;

- Technical information about your mobile device and dashboard camera, such as serial number of your dashboard camera; 

- Contents (such as audio or video recordings, live video or audio streams, images) that is captured or recorded by the Products;

- Data about your activity on and interactions with our Services, including Usage Data and information about your Products, purchase, and subscription;

- Information we obtain from business partners including service active information such as your email address or other contact information, or payment processing; and

- Other personal information contained in content you submit to us, such as through our "Contact Us" feature or customer support tools.  

 

We collect your information in various ways in connection with our Products and Services. We may collect information directly from you through our Mobile Application, email messages, or other digital services. For example, you may be required to provide us with your personal information when setting up an account with us, activating your dashboard camera, or transmitting information to us online. Certain information is collected automatically, such as operating system name and version of your mobile device, device's manufacturer and model. Also, we may receive information about you from other sources, such as Payment Processors. 

 

Privacy and video surveillance laws in your jurisdiction may apply to your use of our Products and Services. You are solely responsible for ensuring that you comply with applicable law when you use our Products or Services. Capturing, recording, or sharing video or audio content that involves other people, or capturing others people's facial feature information, may affect their privacy rights. 

 

 

How We Use Your Information

We may use personal information we obtain about you to:

- Provide and maintain our Products and Services to you;

- Establish and manage your account and profile;

- Identify and authenticate you so you may access certain content or use our certain Services;

- Process and fulfill claims and orders in connection with our Products and Services;

- Inform you about your claims and orders and any changes to our Products and Services;

- Allow you to stream, save, and share contents through our Services;

- Increase and maintain quality and security of our Products and Services, including to support service environment that enables filming and voice recording;

- Communicate with you and provide customer support;

- Perform analytics so we may improve our Services, including to monitor the usage of our Services;

- Operate, manage, analyze, and improve our Products, Services, and business;

- Detect, address, and prevent technical issues;

- Protect against, identify, and prevent fraud and other criminal activity, claims, and other liabilities; or

- Comply with and enforce applicable laws, regulations, legal requirements, relevant industry standards and policies.    

 

If you enroll in our Paid Subscription to use the [Cloud Plan], we may use collected geolocation information of your dashboard camera to provide our GPS tracking service. 

 

We may also use your personal information to send you emails with information about any news or updates, special offers, events and general information of our other products or services. 

 

In any case, we do not use cookies or similar tracking technology for promotional or any purposes.  

 

 

Information Disclosure and Sharing

We may disclose or share your personal information for certain purposes with our (a) affiliates and subsidiaries, and (b) our Service Providers who perform Services on our behalf. 

 

We may disclose personal information about you (a) if we are required to do so by law or legal process (such as court order or subpoena); (b) to establish, exercise or defend our legal rights; (c) when we believe disclosure is necessary or appropriate to prevent physical or other harm or financial loss; (d) in connection with an investigation of suspected or actual illegal activity; (e) upon valid request from government agencies; (f) to protect security and safety of you or public; or (g) otherwise with your consent. 

 

Further, we reserve a right to transfer your information to a third party in the event of reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets, or stock, including in connection with any bankruptcy or similar proceedings.

 

However, we do not sell your personal information. 

 

 

Service Providers

We may use companies, individuals, or contractors ("Service Providers") to perform Services on our behalf or to assist us in providing Services to you. For example, we may engage Service Providers to provide data storage, infrastructure and IT services, to process payments, and to analyze and enhance data. 

 

In the course of providing such Services, these Service Providers may have access to your personal information. We do not authorize them to use or disclose your personal information except in connection with providing their services (which includes maintaining and improving their services) or complying with laws, regulations, and legal requirements.

 

We may use third-party web analytics services to monitor and analyze the use of our Services. The Service Providers that provide these services use automated technologies to collect personal information (such as emails and IP addresses) to evaluate the use of our Mobile Application. 

 

To provide subscription services through in-app purchase, we use Service Providers that provide payment processing, such as Apple Store, Google Play, Paypal ("Payment Processors"). You will make payments through these Payment Processors and directly provide them of your name, billing address and payment card details (including card number, expiration date, and security code). We do not collect or store your payment details from you. 

 

These Payment Processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. Each Payment Processors have their own privacy policy which can be respectively found as follows:

Please note that we have no control over and do not assume any responsibility or liability for the content or practices of any Service Providers and their privacy policies.

 

 

Data Retention

We retain your personal information for as long as needed to provide the Services to you and to use personal information as set out in this Privacy Policy. We will retain and use your personal information to the extent necessary to comply with our legal obligations (for way of example, if we are required to retain your information to comply with applicable laws), resolve disputes, and enforce our agreements and policies.

 

We also retain data collected automatically either generated by the use of the Services or from the Services infrastructure itself (for example, the duration of a page visit) ("Usage Data") for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Services, or we are legally obligated to retain this data for longer time periods. 

 

We will delete all information associated with your account, dashboard camera, mobile device, and Contents upon the deletion or removal of your account. If you unregister or delete a dashboard camera from your account, we will delete all information associated with such dashboard camera, including its geolocation information. In the event you enroll to our Paid Subscription through in-app purchase and afterwards cancel such subscription, we will delete any retained geolocation information associated with your dashboard camera and will no longer collect any geolocation information from it.

Data Transfer

We may transfer, store, and access your information, including personal information, in a jurisdiction different from the one you reside in. Your information may be transferred to, stored and/or used on servers or computers located outside of your state, province, country, or other governmental jurisdiction, such as the Republic of South Korea, where the data protection laws may differ from those of your jurisdiction. Your consent to this transfer, storage, and access is implied in your consent to this Privacy Policy. 

 

Both during transmission and once it is received, we follow generally accepted standards to protect personal information provided to us in accordance with this Privacy Policy. The transferred, stored, or accessed personal information may be subject to the laws of the country or jurisdiction in which it is transferred, stored, or accessed. 

 

 

Your Choices

We offer you reasonable choices in connection with personal information we collect about you. You can request access to your personal information, or to correct, update, delete, or limit the use of your personal information as required by applicable law.

 

Whenever made possible, you can access and update your personal information directly by visiting the "Account Settings" section within our Mobile Application. You may also choose to activate or inactivate our collection of your geolocation information through your mobile device setting. Further, you may opt out, at any time, of receiving email communications from us by following the unsubscribe link at the bottom of each email you receive or changing the setting within the Mobile Application. 

 

If you need our assistance in accessing or making changes to your personal information, please contact our customer support.

 

To the extent required by applicable law, you may have the right: 

 

- To request information about the collection of your personal information;

- To receive a copy of personal information we have collected about you;

- To request deletion of your personal information, subject to exceptions required or permitted under applicable law; and

- To be free from discrimination if you choose to exercise the above rights.

Security

We respect your concerns about your privacy. We use reasonable administrative, logical, physical, and managerial measures to safeguard your personal information against loss, theft, unauthorized access, use, and modification. These measures are designed to provide a level of security appropriate to the risks of processing your personal information. Unfortunately, no measures can be guaranteed to provide 100% security. Accordingly, we cannot guarantee the security of your personal information.

 

 

Children's Privacy

Our Products and Services are intended for a general audience and are not directed to children under the age of 13 ("Children" or "Child").

 

We do not knowingly collect personal information from anyone under the age of 13 and do not willfully disregard the consumer's age. If you are a parent or guardian of a Child and are aware that your Child has provided us with his or her personal information, please contact us. If we become aware of such collection and your desire to deleted such information, we will take steps to remove that information from our servers or data storage.

 

 

Changes to this Privacy Policy

We may update our Privacy Policy from time to time. We will provide notice of any such changes in accordance with applicable law. 

 

We will post a new privacy policy on our Mobile Application or send emails to your registered email address to notify you of significant changes to our Privacy Policy and indicate the effective date at the top of the revised Privacy Policy.

 

You are advised to review this Privacy Policy periodically for any updates. Your continued use of our Products and Services after any such updates take effect will constitute acknowledgement and acceptance of those changes.
